Terms of the ban on fishing in the Brest region

In accordance with the current version of the Rules of fishing and fishing:

Fishing of all types of fish in the fishing grounds of the Brest region is prohibited from March 20 to may 18, with the exception of Amateur fishing, carried out by a fisherman with one fishing rod with one hook or one spinning rod equipped with artificial bait, with one single or double or triple hook in the daytime from the shore (without entering the water) or from ice, from artificial structures*, as well as fishing for eel without observance of fishing measures in places and on conditions annually determined by the Ministry of natural resources and environmental protection.

In addition to the ban on fishing within the time limits specified above, fishing grounds are prohibited from fishing.:

  • common pike fishing – from March 1 to April 15;
  • catfish fishing-from may 19 to June 20, from November 1 to March 31;
  • commercial fishing of all types of fish on wintering pits – from October 1 to April 15.

The list of wintering holes with definition of their borders is specified in the biological and economic and (or) fish-breeding and biological justifications.

Use at this time of any other tools or methods of fishing is a violation of the Rules and is qualified under part 1 of article 15.35 of the administrative Code of the Republic of Belarus, which entails the imposition of a fine on citizens in the amount of 20 to 50 basic units.

In case of illegal fish production during the spring ban, the damage caused is compensated in threefold amount on the basis of taxes established for each type of fish.

For example, for one individual of bream caught illegally, the damage will be 9 basic units, European catfish – 12 basic units, tench – 18 basic units.

If the total amount of damage is 100 or more basic units, criminal liability is provided under article 281 of the Criminal code of the Republic of Belarus

Ban on the use of small-size swimming facilities (boats, boats, etc.)):

The use of small vessels by natural and legal persons in fishing grounds within the period of the prohibition of fishing is prohibited. When the Ministry of natural resources and environmental protection changes the terms of the ban on fishing, respectively, change the terms of the ban on the use of individuals and legal entities in the fishing grounds of small vessels.

This violation is qualified under part 3 of article 15.35 of the administrative Code of the Republic of Belarus and entails a fine of up to 20 basic units.

These requirements do not apply to the bodies of fishing control, security systems of the Republic of Belarus, safety of navigation, Republican unitary enterprises of inland waterways, tenants (users) of fishing grounds in the presence of documents confirming the legality of their stay in fishing grounds to perform their tasks and functions.

In case of need of use by physical and legal entities of small size vessels for movement on water object in economic, transport and other purposes, and also in the course of performance of their office, economic, scientific and sports activity regional Executive committees in coordination with territorial authorities of the Ministry of natural resources and environmental protection have the right to make decisions on permission of use of such vessels in fishing grounds in terms of the ban on fishing. The district Executive committees shall notify the Ministry of natural resources and environmental protection and the state Inspectorate for animal and plant protection under the President of the Republic of Belarus not later than five days before the entry into force of these decisions.

In the period of the ban on the use of the citizens of the small vessels in the fishing area during the spring hunting season hunters are allowed to use small vessels without engines for installation and (or) removing decoy ducks, profiles, stuffed animals and raising of the extracted game.;

It is forbidden to spearfishing anglers who do not have a certificate of underwater hunter, and (or) with the use of scuba equipment and other Autonomous breathing devices, and (or) with the use of underwater guns and (or) pistols, firing a harpoon with a tip of more than five teeth, as well as the production of fish with the use of underwater guns and (or) pistols or other tools for spearfishing from the shore or small boats.

* Except for railway and other bridges, dams, locks, pumping stations and other hydraulic structures, which are subject to restrictions and prohibitions on economic and other activities, and at a distance of 50 m in both directions from them.
