Terms of the ban on fishing in the Brest region

In accordance with the current version of the Rules for the conduct of fisheries and fisheries:

Fishing of all types of fish in the fishing grounds of the Brest region is prohibited from March 20 to May 18, with the exception of amateur fishing carried out by an angler with one rod with one hook or one spinning rod equipped with artificial bait, with one single, double, or triple hook in daylight days from the shore (without entering the water) or from the ice, from artificial structures *, as well as the commercial catch of eel without observing the fishing measure in places and on conditions annually determined by the Ministry of Natural Resources and Environmental Protection.

In addition to the ban on fishing within the timeframes indicated above, in fishing grounds, bans are established on:

  • common pike fishing – from March 1 to April 15;
  • common catfish fishing – from May 19 to June 20, from November 1 to March 31;
  • commercial fishing for all types of fish in wintering pits – from October 1 to April 15.

The list of wintering pits with the definition of their boundaries is indicated in the biological-economic and (or) fish-biological justifications.

The use at this time of any other fishing gear or methods is a violation of the Rules and is qualified under Part 1 of Art. 15.35 of the Administrative Code of the Republic of Belarus, which entails the imposition of a fine on citizens in the amount of 20 to 50 basic units.

In case of illegal fishing during the spring prohibition period, the damage caused is compensated in threefold amount on the basis of the rates established for each type of fish.

For example, for one specimen of bream caught illegally, the harm will be 9 base values, European catfish – 12 base values, tench – 18 base values.

If the total amount of harm is 100 or more basic values, criminal liability is provided for under Art. 281 of the Criminal Code of the Republic of Belarus

Prohibition on the use of small-sized floating facilities (boats, boats, etc.):

It is prohibited to use small boats by individuals and legal entities in fishing grounds during the period of prohibition on fishing. When the Ministry of Natural Resources and Environmental Protection changes the timing of the prohibition on fishing, the terms of the prohibition on the use of small boats by individuals and legal entities in fishing grounds will change accordingly.

This violation is classified under Part 3 of Art. 15.35 of the Administrative Code of the Republic of Belarus and entails the imposition of a fine of up to 20 basic units.

These requirements do not apply to fishing control bodies, security systems of the Republic of Belarus, safety of navigation, republican unitary enterprises of inland waterways, lessees (users) of fishing grounds in the presence of documents confirming the legality of their presence in fishing grounds to perform their tasks and functions. …

If it is necessary for individuals and legal entities to use small boats to move around a water body for economic, transport and other purposes, as well as in the process of performing their official, economic, scientific and sports activities, regional executive committees in agreement with the territorial bodies of the Ministry of Natural Resources and Protection the environment has the right to decide on the permission to use such vessels in fishing grounds during the period of the ban on fishing. District executive committees no later than five days before the entry into force of these decisions shall notify the Ministry of Natural Resources and Environmental Protection and the State Inspectorate for the Protection of Fauna and Flora under the President of the Republic of Belarus.

During the period of the prohibition on the use of small boats by citizens in fishing grounds in the spring hunting season, hunters are allowed to use small boats without engines for installing and (or) removing decoy ducks, profiles, stuffed animals and raising the hunted game;

Spearfishing is prohibited for fishermen who do not have an underwater hunter’s license, and (or) using scuba gear and other self-contained breathing devices, and (or) using underwater guns and (or) pistols firing a harpoon with a tip of more than five teeth, as well as catching fish using underwater guns and (or) pistols or other tools for spearfishing from the shore or from small boats.

* With the exception of railway and other bridges, dams, sluices, pumping stations and other hydraulic structures, in respect of which restrictions and prohibitions on economic and other activities have been established, and at a distance of closer than 50 m to both sides of them.
